            Joseph P. Smith died on July 26, 2021, at Union Correctional Institution in Raiford, at the age of 55. He was convicted of the murder of Carlie Brucia in February 1, 2004. Good that there is one last paedophile on earth now.

Smith was convicted of kidnapping, sexually assaulting, and murdering 11 year old Carlie Brucia in 2004. Florida Man Who Kidnapped, Raped, and Killed 11-Year-Old Girl Found Dead in Prison

A Florida man convicted of kidnapping, raping, and killing an 11-year-old girl has died in prison, putting an end to a protracted appeals process that delayed his execution, authorities say.

Joseph Smith, who was convicted in 2005 of killing young Carlie Brucia a year earlier, had been awaiting the death penalty at Union Correctional Institution. His death at age 55 puts an end to ongoing legal wrangling that could have potentially resulted in his death sentence being overturned or vacated.

“While nothing can bring back Carlie, we are grateful that her family, her friends, and the entire Sarasota community will finally have closure and will not have to endure any further court proceedings to bring Smith to justice,” the statement added.

Officials have not provided a cause of death or any additional details as to how Smith died.

Smith abducted Carlie on Feb. 1, 2004, as she was walking home from a friend’s house in Sarasota, the Bradenton Herald recalled. He then raped and killed her. Surveillance video from the car wash where Smith kidnapped Brucia showed Smith grabbing Brucia by the arm and leading her away, according to local station WTVT.

Carlie’s body was found behind a church four days later, after Smith confessed.

Smith was convicted in 2005 and was sentenced to death in March 2006, following a 10-2 ruling by the jury. At that time, Florida did not require unanimous juries to impose the death penalty.

However, his death sentence was unsettled for years, due to shifting legal interpretations and decisions about unanimity in death penalty sentences. In a 2016 ruling, the U.S. Supreme Court found Florida’s application of the death penalty was unconstitutional, and subsequent reinterpretations of the law led to Smith’s sentence being dropped in April 2018. Then, it was reinstated in April 2020, the Bradenton Herald reports.

A November 2020 ruling from the Florida Supreme Court said that previously vacated death sentences could not be retroactively reinstated. Following this decision, the attorney general’s office reluctantly agreed that under this latest ruling, Smith should have a resentencing hearing.

“While the State feels that it is patently unjust for a resentencing to be required under the circumstances and the State has concerns about the impact of the decision on a trial court’s traditional power to reconsider its prior ruling … this case case should be remanded to the trial court to conduct a capital resentencing,” the attorney general’s office said in a March filing.

“I feel so let down by the system because Joseph Smith was on parole before he got to my daughter and he was supposed to go back to jail for five years if he violated,” Carlie’s father, Joseph Brucia, told local station WTVT. “He did violate. He was quote passed out with a bag of cocaine in a parking lot. Instead of them giving the consequence that they said they would, they gave him drug offender probation, which is just semantics, and that’s why my daughter is not here today.”

“Then they drag this thing on from 2005 to 2021 and still going and it’s not even done yet,” Brucia added. “So, I have a lot of venom and disdain for the criminal justice system.”

The AG’s office directed questions to the Department of Corrections, which declined to provide any comment to Law&Crime beyond confirming Smith’s death on July 26 “while assigned to Union Correctional Institution.”

CLEVELAND, Ohio — Anthony Sowell, the infamous Cleveland serial killer who committed one of the most shocking series of crimes in the city’s history, died Monday afternoon at an Ohio prison hospital of an unspecified illness, a state corrections department official confirmed.

Sowell, 61, was awaiting the death penalty for the gruesome and depraved slayings that have haunted the Mount Pleasant neighborhood since police found the decomposed bodies of 11 women on his property more than a decade ago.

State prison officials on Jan. 21 moved Sowell from death row at the Chillicothe Correctional Institution to the end-of-life care unit at the Franklin Medical Center in Columbus. He died at 3:27 p.m., according to a prisons spokeswoman.

Sowell suffered from a terminal illness, but Ohio Department of Rehabilitation and Correction spokeswoman JoEllen Smith could not say what illness. She said his death is not the result of the coronavirus.

His case became an international news story. It highlighted deep deficiencies within the Cleveland-area criminal justice system that saw several of Sowell’s victims ignored by law enforcement, allowing him to remain free to rape and kill others. It also called into question how seriously police took the families of missing persons known to live on society’s fringes.

Cleveland paid out more than $1.3 million to victims and their families to settle lawsuits over how detectives handled accusations against Sowell before his arrest.

Sowell had been free from prison for several years by October 2009, having served a 15-year sentence for rape when officers went to his Imperial Avenue home as part of a new rape investigation. Investigators found two decomposing bodies on the third floor and a freshly dug grave in the basement.

Police took Sowell into custody two days later. Meanwhile, investigators combed through every inch of the house and the property on which it sat.

In the end, they found the decomposed bodies of 10 women, as well as a skull in a bucket in the basement.

Investigators later determined that Sowell lured the victims – all vulnerable women who struggled with drug addiction – into his home. He raped and strangled them, discarding their bodies in shallow graves, crawl spaces and even out to decompose in the open air.

The victims who escaped later recounted how Sowell lured them into his life and transformed into a monster. Some spoke of police officers who didn’t believe what they reported.

A jury found Sowell guilty in 2011 of dozens of charges, including multiple counts of aggravated murder and other crimes for the women he killed. He was also convicted of trying to kill three women who survived.

Cuyahoga County Common Pleas Judge Dick Ambrose sentenced Sowell to death, rejecting arguments that the hard life lived by the killer – a Marine who had an abusive childhood and may have suffered from mental and cognitive disorders – should be a reason to spare his life.

Sowell, like most death-row inmates, continued to fight his case in court to the end.

The discovery of the bodies in Sowell’s home solved a mystery that had real consequences for the neighborhood and a well-established East Side business. Residents at the time complained of a smell that permeated the neighborhood.

Former City Councilman Zack Reed, whose ward included Mount Pleasant, said there was a woman who lived across the street from Sowell who told him the neighborhood smelled like dead bodies.

Drain pipes were flushed and sewers were replaced because of the smell. The owners of Ray’s Sausage next to Sowell’s house spent nearly $20,000 for new plumbing fixtures, sewer lines and grease traps amid complaints that their operation was the source of the odor.

“Those women never got justice,” Reed said in an interview late Monday after news of Sowell’s death spread. “Those families never got justice. The community never got justice. Ray’s Sausage never got justice. There’s nothing good that came out of that situation.”

A man accused of torturing and murdering his teenage girlfriend has died after being attacked in jail.

Zlatko Sikorsky, 37, was taken to Brisbane’s Princess Alexandra Hospital in a critical condition last Tuesday.

He suffered fatal head injuries during a brawl with another prisoner and spent more than a week on life support.

A spokesperson for Queensland Corrective Services confirmed in a statement he died from his injuries on Friday morning.

“The Queensland Police Service’s Correctional Services Investigation Unit is investigating,” it said.

“Our condolences go out to the man’s family and friends.”

Sikorsky was awaiting trial for charges of murder, torture, deprivation of liberty and interfering with a corpse in relation to the 2018 death of his 16-year-old girlfriend Larissa Beilby.

Beilby was found inside a barrel in the back of a dumped ute in Brisbane’s south in June 2018.

She was reported missing by her father on June 22 and her body not found until several days later.

Death sentence affirmed for Billy Joel Tracy by Texas Court of Criminal Appeals

A Texas prison inmate who was sentenced to death for the 2015 killing of a Barry Telford Unit correctional officer was denied a new trial Wednesday by the Texas Court of Criminal Appeals in a unanimous decision.

Billy Joel Tracy, 42, was found guilty by a Bowie County jury of capital murder in November 2017 and sentenced to death by 102nd District Judge Bobby Lockhart. Tracy beat Timothy Davison, 47, to death with a metal bar used to open slots in the prisoner’s doors at mealtime.

Davison was escorting Tracy back to his one-man cell after an hour of recreation July 15, 2015. Tracy managed to escape his handcuffs and attacked Davison with his fists. Once Davison was on the ground, Tracy grabbed his slot bar, straddled Davison’s body and struck him repeatedly.

The jury at Tracy’s trial watched a video of the beating and heard testimony from dozens of witnesses, including other Texas correctional officers, who had been targets of Tracy’s assaults.

At the time of Davison’s murder, Tracy was serving a life sentence he received in 1998 in Rockwall County for the beating and abduction of a 16-year-old girl. Tracy was sentenced to 45 years for assaulting an officer in Potter County in 2007 and he received a 10-year sentence in 2011 for assaulting an officer in Jones County.

A date for Tracy’s execution has not been set.

NEW BOSTON, Texas: It took about an hour for a Bowie County jury to sentence Billy Joel Tracy to death for the July 15, 2015, slaying of a correctional officer at the Barry Telford Unit.

Tracy, 39, is now headed to the Texas Department of Criminal Justice’s death row. Correctional Officer Timothy Davison was escorting Tracy back to his cell following an hour of recreation July 15, 2015, when Tracy escaped from his handcuffs and attacked. After knocking Davison down, Tracy grabbed the officer’s metal tray slot bar, a tool used to open the slot in cell doors, and beat him with it until Davison’s face was unrecognizable. Davison was pronounced dead a few hours later at a Texarkana hospital.

Tracy’s jury found him guilty of capital murder Oct. 27. Wednesday they sentenced him to death.

Assistant District Attorney Lauren Richards told the jury there has never been evidence which more strongly supports a death sentence in Texas than the testimony the jury heard in Tracy’s trial.

“Someone will receive a death sentence at the end of this trial,” Assistant District Attorney Kelley Crisp argued. “Will it be another correctional officer with TDCJ or will it be Billy Joel Tracy?”

Tracy’s defense attorneys, Mac Cobb of Mount Pleasant and Jeff Harrelson of Texarkana, argued that mitigating circumstances should lead to a sentence of life without parole rather than death, citing brain abnormalities testified to by defense experts and testimony from a defense psychologist that Tracy’s childhood was traumatic.

The jury had to decide if Tracy presents a continuing threat to society and whether any mitigating circumstances would make life without parole the appropriate punishment rather than death. The jury answered yes to the first of the “special issues” and no to the second, leading 102nd District Judge Bobby Lockhart to sentence Tracy to death.

Tracy’s jury heard from many prior victims of Tracy’s violence. A woman who was beaten, burned and dragged into a wooded area in Rockwall, Texas, was among the witnesses.

Tracy was sentenced to two life sentences plus 20 years for the assault on the girl in Rockwall, a related assault on a Rockwall police officer and a home burglary when he attacked Correctional Officer Katie Stanley at the Clements Unit in 2005, nearly killing her.

Tracy was sentenced to an additional 45-year sentence for the attack on Stanley and a 10-year sentence for an attack on former Correctional Officer Brianlee Lomas in 2009. Tracy slashed Lomas’ face, permanently scarring him, at the Robertson Unit. While at the Hughes Unit, Tracy and two other inmates in administrative segregation managed to hatch an escape plan and had sawed through bars in a recreation yard when they were caught. In January 2014, Tracy was moved from Hughes to Telford, where he was held until he murdered Davison.

Tracy constantly mounted minor assaults on prison staff, was constantly found in possession of dangerous contraband, and repeatedly promised he would some day kill a correctional officer, witnesses testified.

Lockhart advised Tracy of his right to appeal his death sentence to the Texas Court of Criminal Appeals as the proceedings ended Wednesday.

Timothy Davison’s brother, Ken Davison, said there will always be a void in the lives of Timothy Davison’s daughters but that he is grateful to the Bowie County District Attorneys Office and the jury for their work.

“I’m relieved,” Ken Davison said. “Justice has been a long time coming.”
